DRUMMOND, District Judge.
The facts, so far as they are material to the decision of the questions in this case, are substantially these: A man by the name of Adams was indebted to the plaintiffs in the sum of about $1,800. Cushing, one of the defendants, was indebted to Adams in the sum of about $1,600, and to secure a note given for the indebtedness Cushing had executed a mortgage or deed of trust on the property in controversy.
