Plaintiff Jeffrey Anderson, conservator of the estate of Earnest Earl Anderson (Anderson), sued St. Bernard’s Hospital and others for injuries Anderson received when he fell from a fourth-story hospital window in 1977. The case was settled prior to going to trial. The Illinois Department of Mental Health and Developmental Disabilities (Department) sought to recover expenses it had incurred in giving long-term medical and psychiatric treatment to Anderson after his fall.
