It was not charged nor is there evidence that the alien has advocated the forcible overthrow of the government of the United States. Nor was there charge or proof that he entertained views inimical to constitutional government, or that he at any time possessed or distributed literature subversive of the Constitution. The accusation is that he was a member of or was affiliated with an organization, namely, the Communist party, which did those things.
