This action is prosecuted under section 366 of the Code to recover possession of the office of register of deeds, which the defendant is alleged to have usurped and to hold, claiming a right thereto by virtue of an election held on the Tuesday next after the first Monday in November, 1880, and into which he was inducted by the board of county commissioners.
