GARRETT, Chief Justice.

This suit was brought by the State of Texas for • the use of Nacogdoches County against A. J. Spradley, formerly a sheriff of the county, and the sureties upon his official bond, for the recovery of certain fines and costs adjudged against certain persons convicted of misdemeanors in the County Court of said county and remanded to the custody of the sheriff until such fine and costs were paid. The sums claimed amount to $1007.75. It was charged that the said Spradley permitted the said persons to go at large and willfully neglected and refused to collect said fines and…
