SHIRAS, District Judge.
In the bill filed in this case, it is ' averred: That the Winnebago tribe of Indians was originally domiciled on lands situated in tbe state of Minnesota. That by the provisions of the act of congress approved February 21, 1863, tbe president of tbe United States was authorized to take steps for the peaceful removal of the tribe from that state, and to set apart for the use of the tribe a tract of unoccupied land, not within tbe limits of any state, and in extent at least equal to tbeir existing reservation in Minnesota.
