ORDER GRANTING MOTION TO DISMISS

This cause is before the Court on counterclaim-defendant Charles Fuquay’s Motion to Dismiss, filed herein on June 22, 1981.
This case is presently set for trial before the undersigned on the personal injury claim of Linda and Charles Fuquay for injuries sustained in 1975 by plaintiff Linda Fuquay. According to the allegations of the Complaint, plaintiff’s then-husband Charles Fuquay removed the radiator cap from the family van and the radiator exploded, causing burns over a portion of Linda’s body.
