CALHOUN, Judge.

The conviction was for murder and the punishment assessed at four years in the penitentiary.

Appellant operated a hamburger stand in the city of Mt. Vernon. Nearby was a hilling station. About the noon hour on Sunday, the deceased and his eighteen year old son came into appellant’s place of business in a drunken condition. Deceased was cursing and applying vile epithets to those in and around and about the place of business.
