—In an action to foreclose a mortgage on real property, the plaintiff appeals from so much of an order of the Supreme Court, Westchester County (Fredman, J.), entered January 17, 1997, as denied that branch of its motion which was for summary judgment against the defendant Konstantinos Panapakides.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, and that branch of the motion which was for summary judgment against the defendant Konstantinos Panapakides is granted.
