DUFFY, Circuit Judge.
Plaintiff brought this suit in the District Court to recover damages for personal injuries. Jurisdiction was based upon alleged diversity of citizenship. A trial was held before the Court upon the preliminary issue of jurisdiction and oral and documentary evidence was received. The trial court filed findings of fact and conclusions of law. The Court found that on May 22, 1963, the date when the instant suit was commenced, plaintiff was a domiciliary and citizen of the State of Indiana.
