The Bass Dry Goods Company, a corporation, brought an action against the Granite City Manufacturing Company,, a partnership, and against the partners individually, for a breach of a contract for the sale of goods. The record discloses that Brown, one of the partners, in his capacity as a member of the firm, made a contract of sale of certain goods to the plaintiff at a stipulated price. The defendants failed and refused to deliver the goods.
