Judgment, Supreme Court, New York County (Carol Berk-man, J.), rendered August 17, 2012, convicting defendant, after a nonjury trial, of attempted possession of burglar’s tools, and sentencing him to a term of 90 days, unanimously reversed, on the law and the facts, and the accusatory instrument dismissed.
