ANDREW'S. J.

The district court of Oklahoma county, over the protest of the pligoitiffs in error, entered its order directing the issuance of a permit to drill a well for oil and gas. From that order they appealed to this court.

It is admitted that the area of the tract on which it is sought to drill the well is less than that required by the provisions of ordinance No. 3944 of the city of Oklahoma City. The trial court made the order com plained of under the provisions of chapter 178, Session Laws 1923, providing for exceptions.
