The above-entitled proceedings were instituted by Esther Menzie, life beneficiary under the will of George W. Menzie, deceased, by the filing of a petition September 8, 1906, asking that George L. Menzie, testamentary trustee under the will of said decedent, be required to make and file and proceed to an accounting and judicial settlement of his accounts as such trustee.
