Defendant, Danny S. Wilkins III, appeals from an order that granted the state’s motion for summary judgment on Wilkins’s petition for postconviction relief.

Wilkins was indicted on one count of kidnapping, in violation of R.C. 2905.01, on September 14,1993. On April 11,1994, Wilkins filed a motion to dismiss, seeking discharge pursuant to R.C. 2945.73 for violation of his speedy trial rights.
