This is an action which seeks to recover a refund of federal estate taxes which were paid following the disallowance of a claimed charitable deduction in connection with a bequest to the Denver Medical Society. The validity of the disallowance is in issue. The amount of the refund sought by plaintiff is $40,-354.27. The case was tried to the Court, briefs were submitted and oral arguments have been made.
