Gehrken's Appeal

Pennsylvania Court of Common Pleas, Lawrence County

Decided February 4, 1944No. 22Published

1Opinion of the Court

Braham, P. J.,

May a summons in trespass in an action before a justice of the peace of the county where the cause of action arose be served in another county by a constable of the second county? Where the record shows that this was the only method of service, is the judgment void or only voidable? Where the Secretary of Revenue has forfeited an automobile driver’s license for failure to pay such a judgment, is the judgment so invalid as to require a reversal of the order of suspension? These are the questions raised by this appeal from the order of suspension.
