This action was brought by the plaintiff, who claimed to be the owner of a certain quarter section of land situate in Davison county, S. D., and who sought to quiet title in and to said land as against the defendants herein. The defendant Mary J. Bidwell, by her separate answer, claimed to be the owner in fee simple of an undivided one-third of the said tract of land. Such defendant further claimed that the plaintiff had been in possession of said land, and that she was entitled to judgment for rentals as against such plaintiff.
