The appellant, Parker, was the owner of certain real estate in Custer county, S. D. On June 26, 1923, an agreement was entered into between the appellant and the Custer State Park Board, whereby it was agreed that a deed to appellant’s land executed by the appellant should be “placed in the First National Bank, Custer, South Dakota, in escrow.” The grantee in the deedl was the respondent, state of South Dakota.
