This is an appeal from an order and judgment of the United States District Court for the Southern District of New York (Sweet, J.) dismissing appellant’s complaint on motion. The complaint asked for declaratory and injunctive relief based on allegations that the New York Senate’s procedure for a “fast roll call” vote violated the Guarantee Clause of article IV, section 4, of the United States Constitution, and, as used in enacting a sales and use tax in the twelve counties served by the Metropolitan Transportation Authority, denied appellant equal protection and…
