Tbis cause was tried in June, 1912, and a verdict returned for defendant. On motion of tbe plaintiff tbis verdict was set aside and a new trial granted because of instructions given wbicb tbe trial court upon reflection deemed erroneous. An appeal was taken by defendant to tbis court from tbe order granting a new trial. Tbis appeal was by order of tbis court, on motion of tbe plaintiff, dismissed for want of prosecution on January 28, 1913. Tbe parties thereafter went to trial a second time, and upon tbe latter trial a special verdict…
