This is a suit for damages alleged to have accrued to tbe plaintiff as a result of personal injuries received while in defendant’s employ as a section band on its railroad. Plaintiff recovered and tbe defendant appeals. Tbe plaintiff bad been in tbe defendant’s employ on tbe section between two and three months prior to the date of bis injury. Tbe negligence relied upon for a recovery is an alleged careless act of tbe defendant’s section foreman in applying tbe brake, without warning, on tbe car on which tbe plaintiff and others were riding, in such a manner as to occasion tbe sudden stopping…
