KRUEGER, Judge.

The appellant was tried and convicted of the offense of murder with malice aforethought, and his punishment was assessed at confinement in the State penitentiary for a term of ten years.

The record shows that on the night of the 18th day of August, 1933, Miss Beatrice Jordan went to a dance at the town of Batson in an automobile belonging to John Bishop. She parked the car at the southeast corner of Dr. Glass’ office near the dance hall. After she had been at the dance for approximately one hour she decided to go home.
