Although various causes of action were set out in the complaint, upon this appeal only the questions involved in the trial of the issues upon the first cause of action and the defendant’s counter-claim are brought up for review. The complaint alleges that the plaintiffs were co-partners in the firm of Reilly & O’Connor, and that in June, 1889, they entered into a contract with the defendant, whereby they agreed to execute, construct, and finish all the masonry work required to be done by the said defendant for the bridge to be constructed by the "Pennsylvania, Poughkeepsie & Boston Railroad…
