In 2004, plaintiffs Habitat Education Center, David Zaber, Ricardo Jomarron, Don Waller, and the Environmental Law and Policy Center brought this action pursuant to the Administrative Procedure Act (“APA”), 5 U.S.C. § 706, against the United States Forest Service and other federal officials and entities. 1 Plaintiffs challenged the Forest Service’s approval of the McCaslin timber project in the Chequamegon-Nicolet National Forest (“CNNF”).
