The administrators of Tulane Educational Fund, wishing to acquire a large area of land in this city for the expansion of Tulane University employed a real estate agent, J. S. Saxton, to secure options from the numerous owners of the city lots that would have to be blocked together for making up the desired extent. The defendant firm and the two members of the firm individually owned some of these lots, and held themselves out as having authority to- sell others of them, and Saxton executed with them two contracts, one of which only need, be reproduced here, as the two are *471word for. word…
