M. L. Coxwell was in the sanitorium at Booneville, Arkansas, for treatment for tuberculosis, and while there at four o’clock in the morning of May 21, 1929, was stricken with acute appendicitis. He was advised by the doctor in charge of the sanitorium that he had appendicitis, and that he would have to g'o to some other hospital for an operation, and asked him where he wanted to go. Appellee told him he wanted first to go home and consult with his family doctor. His home was at Corning, Arkansas.
