William Philbrick was convicted in Douglas county of feloniously assaulting his- wife with intent to commit murder. He was sentenced to the penitentiary for an indeterminate period of not less than 2 nor more than 15 years, and has brought the case here on error for review.

The evidence tends to prove that Philbrick and his wife frequently engaged in domestic broils; that some of their trouble grew out of the care of their three children, aged *121from five to nine years; that owing to a strike defendant, a boilermaker by trade, was unemployed for a month or more before his arrest, except for odd…
