The facts appearing upon this application are as follows: • The prisoner was indicted, tried and convicted in the Court of General Sessions of the Peace in and for the city and county of Mew York, on the 2Sth day of February, 1865, of the crime of murder in the first degree, and sentenced to be executed on the 31st of March following. On the day of his conviction and sentence, the case was removed, by a writ of error, to the Supreme Court for review, and on the 22d of December, 1865, the judgment of the Sessions was affirmed by that court.
