KRUEGER, Judge. —

Appellant was convicted of the offense of theft of cattle, and his punishment was assessed at confinement in the state penitentiary for a term of two years.

Appellant was charged by indictment with the theft of thirteen head of cattle from T. R. Copeland. The only question presented for our consideration is the sufficiency of the testimony to sustain the conviction.

The record discloses that Copeland had some cattle which he desired to sell; that on the morning of October 21 appellant went to the home of Copeland, inspected the cattle, and agreed to buy them. The price agreed…
