This is an action brought by an insurance carrier as assignee of the claim of an injured workman pursuant to section 29 of the Workmen’s Compensation Law (as amd. by Laws of 1924, chap. 499) against a third person, whose negligence is claimed to have caused the injuries complained of. The examination of the circumstances under which the accident occurred discloses that this was a maritime tort. The employee while working on a barge in the Hudson river was injured by being struck by a scoop attached to a derrick on another vessel known as a “ digger.” Both the barge and the digger were…
