The County Court of Wyoming County dismissed a writ of habeas corpus. The relator appeals to this court. Briefly stated, it is appellant’s contention that the County Court of Erie County had no jurisdiction to take his plea and pronounce judgment upon him. The record before us shows that the appellant was indicted by a Grand Jury at the April, 1951, Criminal Term of the Supreme Court in the County of Erie for the crime of burglary, third degree, attempted grand larceny in the first degree and violation of section 408 of the Penal Law.
