Rosemary McCullough sued Houston County, Texas and David Cervantes (indi vidually and in his official capacity as Houston County District Attorney) (collectively “Appellees”) for racial and age discrimination and retaliation pursuant to Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e-2(a) (2003), 42 U.S.C. § 1983, and the Age Discrimination in Employment Act, 29 U.S.C. §§ 621-634 (2006) (“ADEA”). 1 The district court granted Appellees’ motions for summary judgment on all of McCullough’s claims.
