This was a suit oñ account .commenced by tbe defendant in error, plaintiff below, against the plaintiff in error, defendant below, in the district court of Oklahoma county, to recover the price of certain goods, wares, and merchandise sold and delivered by the plaintiff to the defendant, upon which account at the time the suit was commenced there was alleged to be due and unpaid the sum of $1,036.41.
