Carl N. Craig, State Auditor, instituted this suit against John B. Wheat and others comprising the Board of Supervisors of Hancock County and the surety on their bonds *267for an illegal expenditure of county funds. From a decree dismissing the bill of complaint, the auditor appeals.

On March 9, 1946, the legislature of this state enacted Chapter 219, General Laws of Miss. 1946, authorizing the repair, improvement, and construction by the supervisors of roads and bridges in the respective counties of this state and appropriating money to be paid to them by the state for such purposes.…
