JAMES, Chief Justice.
— Trespass to try title brought by Gunn against J. T. R. Jouett and others, Jouett alone suing out the writ of error. The facts, so far as they are material to the conclusions of law we have reached, are as follows:
The survey of which the land sued for is a part, was patented in February, 1845, to Thomas Jouett as his headright. There was a deed from "Thomas Jouett (his wife, whose signature was not necessary, joining) to Vincent B. Timms, dated January 22, 1846!
