OPINION

By MORGAN, J.

The Common Pleas Court in this case granted the defendant’s motion for judgment on the pleadings. The plaintiff appeals.

The facts as shown by the pleadings are as follows: Plaintiff and Defendant were joint owners of real estate mortgaged to the National City Bank of Cleveland to secure the payment of a note to the bank on which the plaintiff and the defendant were co-makers. The bank filed an action in the common pleas court of this county on the note and for foreclosure of the mortgage, and on July 27, 1936, recovered a judgment against the; plaintiff and defendant,…
