VERON, District Judge.

I. INTRODUCTION

Plaintiff, Peter Joseph Caldarera, Jr., a resident of Lake Charles, Louisiana, instituted this action in the United States District Court for the Eastern District of Louisiana on December 24,1975 against Eastern Airlines. Jurisdiction was based on diversity of citizenship pursuant to 28 U.S.C. § 1332 and plaintiff requested trial by jury.
