CHRISTIAN, Judge.

The offense is burglary; the punishment, confinement in the penitentiary for two years.

The motion for new trial was overruled on the 16th day of November, 1929, ánd notice of appeal given on the same date. The statement of facts was filed in the trial court on February 15, 1930, which was more than ninety days after notice of appeal was given. The trial court granted appellant ninety days from the adjournment of the court in which to file bills of exception and statement of facts.
