This case came before the Court on September 1,1994, for argument on the Defendants’ Demurrer and Plea of the Statute of Limitations to the Motion for Declaratory Judgment and Other Relief based on the town’s failure to extend sewer service to the Petitioner’s property pursuant to an annexation order of December 31, 1976.
