Seth Orrin Danner was convicted of murder in the first degree. The jury fixed his punishment at death and the court entered judgment accordingly. The defendant moved for a new trial which was denied. He has appealed from the judgment and from the order denying the motion.

I. It is urged that the evidence is insufficient to sustain the verdict. We need not enter into detail. Admittedly the body' of Florence Sprouse, with whose murder the defendant stands charged, with that of her husband, John Sprouse, also murdered, was cast by the defendant into a pit which he prepared for the purpose, and…
