BUSSEY, Presiding Judge:

Appellant, Richard McDaris, hereinafter referred to as defendant, was charged, tried, and convicted in the District Court of Kay County, Oklahoma, for the offense of Malicious Injury to Property; his punishment was fixed at thirty (30) days in the county jail and One Plundred Dollars ($100.00) fine, and from said judgment and sentence, a timely appeal has been perfected to this Court.
