Appeal by tbe defendant, Jane Jones, from a judgment of the County Court of Wyoming county, rendered on tbe 30th day of March, 1908, convicting her of the crime of keeping a disorderly house.

Spring, J.:
The defendant has been convicted of maintaining a disorderly house, a place of public resort, in that it was so kept as to habitually disturb the “peace, comfort and decency in the neighborhood” where it was located. (Penal Code, § 322.) A former judgment of conviction on this indictment, affirmed by this court (122 App. Div. 895), was reversed by the Court of Appeals for errors in the reception of evidence, the court holding, however, that the evidence was sufficient to sustain the crime charged.
