DECISION

The Defendant, Roger Williams Medical (Defendant), moves this Court to dismiss the appeal of Plaintiffs Kenneth J. Gianquitti and Denise Gianquitti (Plaintiffs) in the above-entitled action for failure to cause timely transmission of the record for appeal. Defendant Atwood Medical Associates, Ltd. joins in Defendant's motion to dismiss. The Plaintiffs have objected to this motion to dismiss.
