Appeal from a judgment of the superior court for King county, Ronald, J., entered May 15, 1911, upon findings in favor of the plaintiff, in an action upon a promissory note, after a trial to the court.

This action was brought in May, 1911, by the respondent, the Canadian Bank of Commerce, against the appellant, the John J. Sesnon Company and the defendant the J. S. Kimball Company, to recover upon a promissory note, made and delivered by the Sesnon Company to the Kimball Company, and by the latter company indorsed and delivered to the bank. The note was a demand note for the *436sum of $10,000, and provided for interest payable monthly at the rate of six per centum per annum.
