THOMAS, Justice.
In his appeal from a conviction of aggravated assault in violation of Wyo. Stat. Ann. § 6-2-502(a)(ii) (Michie 1997), Elmer Streitmatter (Streitmatter) raises the constitutionality of the statute under which he was convicted. In a related claim of error, he asserts that the trial court failed to properly instruct the jury on the elements of the crime.
