Plaintiffs initiated this action on August 26, 2005, pursuant to the judicial review provision of the Administrative Procedure Act (“APA”), 5 U.S.C. § 706, seeking to compel defendants’ compliance with the National Environmental Policy Act (“NEPA”), 42 U.S.C. §§ 4321 et seq., and to enforce the “Stipulation of Compromise Settlement” (“Stipulation”) entered into by the parties in 1987 in connection with prior litigation in this court entitled Coalition on West Valley Nuclear Wastes, et al. v.
