This was an action [by Henry L. Pierson and Samuel Hopkins] to recover back an alleged excess of duties paid to the defendant [Cornelius W. Lawrence], as collector of the port of New York, on certain importations of iron. A verdict was taken for the plaintiffs, subject to the opinion of the court.

BETTS, District Judge.

This cause was decided by the court at the last term, but, at the instance of the counsel for the plaintiffs, the opinion of the court was withheld, and leave was given to the plaintiffs to apply to the court at the present term for a re-hearing, upon the suggestion that important facts had been overlooked by the court, or had not been properly presented to their' attention.
