This is a patent case which comes before this court through a special jurisdictional act approved April 18, 1924, which act is as follows:

“ Be it enacted by the Senate and Mouse of Representatives of the United States of America in Congress assembled, That the United States Court of Claims be, and it is hereby, authorized and directed to hear and determine the claim of Elwood Grissinger for compensation for any unlawful sale by the United States, and any unlawful sale by others for the United States, either in the United States or elsewhere, for any use outside the United States and exclusive *138…
