This suit was brought by appellee against appellant to recover damages on account of the arrest and imprisonment of the plaintiff on a charge of false pretenses.

Count 1 was withdrawn, and the cause proceeded to trial upon counts 2 and 3. The second count sought recovery for malicious prosecution, and the third for false imprisonment. Demurrers were sustained to pleas B and C, and this action of the court constitutes the first assignment of error.
